A California lawmaker wants to decriminalize jaywalking by making it legal to cross the street out of an intersection “when it is safe to do so.”
Asm. Phil Ting, a Democrat from San Francisco, dubbed his 2147 Assembly bill the “Freedom to Walk Act.” His colleagues in the state lower house passed the legislation this week, passing it through the state Senate.
The bill would effectively prevent police from suing pedestrians for jaywalking if the road were clear, Ting’s office said in a statement. The legislator claims to seek “fairness in fines” and to avoid “potentially escalated police stops”.
He also cited racial disparities in tickets for the misdemeanor, saying they are “given disproportionately to people of color and individuals of modest means.”
“We should encourage people to get out of their cars and walk more for health and environmental reasons,” Ting said in a statement. “But when expensive tickets and unnecessary confrontations with the police only impact certain communities, it’s time to reconsider how we use our law enforcement resources and whether our pedestrian laws really protect pedestrians.”
The bill is Ting’s second attempt to decriminalize jaywalking in California. This release made technical changes to address concerns that led Governor Gavin Newsom to veto the first attempt. In its response to the bill, Newsom said the proposal raised an “important issue,” but cited security concerns about repealing state jaywalking laws altogether.
Instead, Ting says his new bill strictly defines when an officer can stop a pedestrian for jaywalking, which is “only when a reasonably alert person would realize there is an immediate danger of collision.”
In addition to his concerns about uneven enforcement, Ting said infrastructure inequalities also impact jaywalking. According to a UC Berkeley study, poorer neighborhoods are more likely to be devoid of pedestrian crossing buttons and pedestrian crossings.
California has already moved away from some elements of the jaywalking laws, which date back to the automotive boom of the 1930s.
